Terms of service
1. Exemption from Standard Right to Cancel (UK Consumer Law) Under the UK Consumer Contracts Regulations, customers normally have a 14-day "cooling-off" period to return items for any reason. However, custom-made goods are legally exempt from this. You must state this clearly in your Terms.
-
What to add: "Because our products are made to your exact specifications and custom-printed to order, the standard 14-day right to cancel under the Consumer Contracts Regulations does not apply. All orders are final once placed, and we do not accept returns for change of mind."
2. Intellectual Property & Copyright You are selling artwork, so you must protect your intellectual property. Buying a print does not give the customer the right to copy or use the image commercially.
-
What to add: "All artwork, images, designs, and content on this website are the intellectual property of Real Wales. Purchasing a physical print does not transfer any copyright or reproduction rights to the buyer. You may not reproduce, resell, alter, or use our artwork for any commercial purpose without prior written consent."
3. Color Accuracy Disclaimer Because every monitor displays colors differently, the printed artwork might look slightly different than it does on the customer's phone or computer screen. This clause protects you from "item not as described" claims based on minor color variances.
-
What to add: "We make every effort to display as accurately as possible the colors and images of our artwork. However, we cannot guarantee that your computer monitor or device's display of any color will be completely accurate. Minor variations in color between the digital image and the final printed product are normal and do not constitute a defect."
4. Order Cancellation Window Since items are sent to a printing partner, you need to clarify if or when a customer can cancel an order if they make a mistake.
-
What to add: "As our prints are made to order, the production process often begins shortly after your order is placed. Therefore, we cannot guarantee that cancellations or changes can be accommodated once an order is submitted. If you need to change your order, please contact us immediately, and we will do our best to intercept it before printing begins, but this is not guaranteed."
5. Third-Party Fulfillment & Shipping Your delivery page mentions a "printing partner's express tracked service." Your ToS should reflect that you use third parties for fulfillment and that delivery timeframes are estimates.
-
What to add: "We utilize a third-party printing partner to custom-print and fulfill your artwork. While we offer free UK delivery and aim to dispatch items promptly via express tracked services, all delivery timeframes provided are estimates. We are not liable for delays caused by the printing partner, postal strikes, or severe weather."
6. Damaged Goods Procedure Link your ToS directly back to the Returns policy you just created.
-
What to add: "If your custom artwork arrives damaged or defective, our liability is limited to providing a replacement of the same item. Please refer to our Returns & Refund Policy for instructions on reporting damaged items."
